A legal expert warned Thursday the Trump administration is weaponizing a new tool aimed at putting the kibosh on legal challenges, CNN reported.

The White House distributed a memo to agency leaders Thursday that announced, “It is the policy of the United States to demand that parties seeking injunctions against the Federal Government must cover the costs and damages incurred if the Government is ultimately found to have been wrongfully enjoined or restrained.”

“Federal courts should hold litigants accountable for their misrepresentations and ill-granted injunctions,” the memo added.

The report noted that the rule requiring up-front payments in lawsuits is “virtually unheard of in courts across the country.”

Legal experts agreed and warned it could become a powerful weapon as Trump beats back a deluge of legal challenges.

“It is a very bold move that violates norms,” attorney Mark Zaid told the outlet “This is going to be thrown open to the courts … Theoretically, this could be an (sic) incredibly powerful for the Trump administration.”

Zaid said that the Trump administration will try to take advantage of any loophole and opportunity to hinder challenges, but that in this case, “they actually have identified something that on its face looks to be a utility to rely upon.”

The memo comes as nearly 100 emergency lawsuits have been filed in federal courts against the Trump administration, according to the report. These lawsuits primarily challenge changes in immigration and diversity policies, budget freezes, federal employee dismissals, and initiatives led by Elon Musk’s Department of Government Efficiency.
